Stamp duty and registration in Tamil Nadu
Tamil Nadu has no reduced rate for short agreements: any lease under 30 years is charged 1% of the rent plus, since 2024, the security deposit. The widespread habit of printing 11-month agreements on ₹20 or ₹100 stamp paper is under-stamping, and an under-stamped document can be penalised if it is ever produced in court. Buy an SHCIL e-stamp at the sub-registrar office or an authorised bank and confirm the amount there.
Separately, the Tamil Nadu tenancy law of 2017 requires every tenancy agreement to be registered with the Rent Authority within 90 days, online, whatever the term. An unregistered agreement cannot be used before the Rent Court. This is a different step from registering at the sub-registrar office, which is needed only for 12 months or more.
The same law caps the security deposit for homes at three months' rent.
